Article 1 — Seller

Hereinafter “the Seller” or “the Artist”.
Article 2 — Purpose and scope
These general terms of sale govern sales of original works of art and services offered by the Seller to consumers within the meaning of French consumer law. Any order implies unreserved acceptance of these terms.
Article 3 — Works offered
The works presented are unique pieces, carved by hand. Each work is sold in a single copy: once sold, it cannot be reproduced identically. Variations in shade, grain and patina are inherent to the natural materials used and do not constitute a defect.
Photographs illustrate the works as faithfully as possible, with no contractual commitment on the exact rendering of colours, which depends on the viewing screen.
Some works are marked as belonging to a partner gallery: the purchase is then made on the partner’s platform, under its own terms of sale. These terms do not apply to them.
Article 4 — Prices
Prices are shown in euros, excluding delivery costs. VAT not applicable, Article 293 B of the French General Tax Code: the Seller benefits from the VAT exemption scheme. The prices shown are net prices, with no VAT charged or recoverable.
The Seller reserves the right to change prices at any time. Works are invoiced on the basis of the rate in force when the order is validated.
Article 5 — Orders
The order is deemed concluded when the Buyer validates the basket, accepts these terms and pays. A confirmation email summarising the order is sent to the Buyer.
The Seller reserves the right to refuse an order in the event of a prior dispute, a manifestly abnormal order or unavailability of the work.
Article 6 — Payment
[TO CONFIRM] Payment methods to be confirmed once accounts are open: card via PayPal or Stripe, and bank transfer.
No banking data is collected or stored by the Seller: payments are handled directly by the payment provider on its secure infrastructure.
The work remains the Seller’s property until full payment is received.
Article 7 — Delivery
[TO CONFIRM] Areas served, carrier, times and costs to be defined. Given the fragility and weight of the sculptures, collection from the workshop or hand delivery may be preferred.
Works travel carefully packed. Risk transfers on physical delivery of the item to the Buyer.
On receipt, the Buyer is invited to check the condition of the parcel and to make any reservation with the carrier, then inform the Seller as soon as possible.
Article 8 — Right of withdrawal
Under Article L221-18 of the French Consumer Code, a consumer Buyer has fourteen days from receipt of the work to exercise their right of withdrawal, without having to give reasons or bear penalties.
To exercise it, simply inform the Seller by an unambiguous statement via the contact form. The work must be returned in its original condition, complete and carefully packed. Return costs remain the Buyer’s responsibility. The refund is made within fourteen days of recovering the work.
Important exception. Under Article L221-28 3° of the Consumer Code, the right of withdrawal does not apply to works made to order, produced to the Buyer’s specifications or clearly personalised — in particular stock engravings and commissioned sculptures.
Article 9 — Legal guarantees
All works benefit from the legal guarantees, independently of any commercial guarantee:
- the legal guarantee of conformity (Articles L217-3 et seq. of the Consumer Code), for two years from delivery;
- the guarantee against hidden defects (Articles 1641 et seq. of the Civil Code), for two years from discovery of the defect.
These guarantees do not cover normal wear, alterations due to storage conditions, or the natural evolution of living materials such as wood.
Article 10 — Copyright and resale right
The sale of a work transfers no copyright. The Artist retains their moral and economic rights, in particular the right to reproduce and exhibit photographs of the work.
The Buyer undertakes not to impair the integrity of the work or to present it under a name other than the Artist’s.
A later resale through an art-market professional may give rise to the resale right for the Artist, under Articles L122-8 and R122-2 et seq. of the Intellectual Property Code.
Article 11 — Personal data
Data processing is described in the privacy policy.
Article 12 — Complaints and mediation
Any complaint may be sent to the Seller via the contact form.
[TO CONFIRM] Membership of a consumer mediator is MANDATORY for any professional selling to consumers (Art. L612-1). An approved mediator must be appointed and their name, address and website added here.
The Buyer may also use the European online dispute resolution platform: ec.europa.eu/consumers/odr
Article 13 — Governing law
These terms are governed by French law. In the event of a dispute, an amicable solution will be sought before any legal action. Failing this, the French courts have jurisdiction under ordinary law.
